  • Contractors: The EPA’s Renovation, Repair, and Painting (RRP) Rule requires contractors working on pre-1978 homes, schools, and child care facilities to be certified and follow lead-safe work practices.


When is testing required?

  • Before renovation or demolition of older structures
  • During real estate transactions involving pre-1978 properties
  • In rental properties where children under 6 live


Fines for noncompliance can reach up to $43,000 per violation per day under the RRP Rule.


2. Asbestos Testing Requirements

Is asbestos testing required before demolition or renovation?

Yes, asbestos testing is required federally and at the state level. In New York, asbestos surveys are mandatory before disturbing any building material in commercial or residential buildings, regardless of the age of the structure.


Key laws and regulations include:

  • EPA’s National Emission Standards for Hazardous Air Pollutants (NESHAP)
  • OSHA regulations for worker safety
  • New York State Code Rule 56, which governs asbestos handling and disposal


You must have an asbestos inspection completed by a licensed inspector prior to any demolition or renovation, even if you believe the building materials are newer.


3. Soil Testing Requirements

When is soil testing legally required?

  • Before new construction or redevelopment of former industrial, agricultural, or commercial sites
  • On brownfields or contaminated sites under programs like New York’s Brownfield Cleanup Program (BCP)
  • In areas near known environmental spills or hazardous waste sites


State and federal agencies such as the New York Department of Environmental Conservation (DEC) and the EPA may mandate soil testing to detect contaminants like lead, arsenic, petroleum, PCBs, and asbestos.

Failing to test can halt construction and lead to liability for environmental damages.
